Our Products and Services

TruWatch provides fire-safety and life-safety products and services, including smoke alarms, heat detectors, carbon monoxide (CO) detectors, fire extinguishers, monitored fire and safety systems, and medical alert products, along with installation, inspection, and monitoring services for residential and commercial customers.

If you purchase products or enter into a service, installation, inspection, or monitoring agreement with us, that agreement contains additional terms specific to those products or services. Where those agreement terms differ from these Terms, the agreement terms control for those products and services.

Using the Website

You agree to use the Site only for lawful purposes. You may not:

• Use the Site in any way that violates applicable law or regulation
• Attempt to gain unauthorized access to the Site, its servers, or related systems
• Interfere with the Site’s operation or introduce malicious code
• Submit false or misleading information through our forms, including another person’s phone number without their authorization

Information on the Site is provided for general informational purposes and is not a substitute for a professional fire-safety assessment of your specific property or for compliance with applicable fire codes.

SMS / Text Messaging Terms

These SMS / Text Messaging Terms apply to the TruWatch text messaging program (the “SMS Program”).

Consent to Receive Text Messages

By checking the optional SMS consent box (unchecked by default) on our web forms (including https://truwatch.com/contacttruwatch/), or by expressly agreeing verbally when speaking with our staff, you consent to receive text messages from TruWatch at the mobile number you provided, sent via an automated system. Entering your phone number on the form does not by itself enroll you in the SMS Program, and the consent box is not required to submit the form. Consent to receive text messages is not a condition of any purchase or of receiving any product or service from TruWatch.

Message Types

The SMS Program is used for transactional and customer-care messages only, including:

• Appointment, inspection, and service-visit reminders and confirmations
• Account, order, and service notifications (for example, follow-ups related to monitoring alerts, and order or shipping updates)
• Customer-care replies to your inquiries

We do not send marketing or promotional text messages through this program.

Message Frequency

Message frequency varies and depends on your interactions with us — for example, how many appointments, orders, or inquiries you have.

Cost

Message and data rates may apply according to your mobile carrier plan. TruWatch does not charge you for text messages, but your carrier’s standard messaging and data charges apply.

Opting Out

You can opt out at any time by replying STOP to any text message from TruWatch. After you send STOP, we will send you one final message confirming that you have been unsubscribed, and you will receive no further text messages from us unless you opt in again.

Carriers and Delivery

Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed. Because text messaging may be delayed or fail, you should not rely on text messages as your sole source of time-sensitive safety information.

Number Changes

You are responsible for notifying TruWatch promptly if you change or deactivate your mobile phone number, so that messages intended for you are not sent to someone else. You can notify us at info@truwatch.com or 262-236-0123.

Privacy

Information collected through the SMS Program is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent are not shared with any third parties.

Intellectual Property

The Site and its contents — including text, graphics, logos, images, and software — are owned by or licensed to TruWatch International LLC and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from the Site’s content without our prior written permission, except for your own personal, non-commercial use.

Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in this section limits any warranties expressly provided in a written product or service agreement between you and TruWatch, and nothing in these Terms limits rights you may have under applicable law that cannot be waived.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRUWATCH AND TRUWATCH INTERNATIONAL LLC, AND THEIR OFFICERS, EMPLOYEES, AND AGENTS, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR THE SMS PROGRAM, INCLUDING DAMAGES RESULTING FROM DELAYED OR UNDELIVERED MESSAGES. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. Liability relating to purchased products and contracted services is governed by the applicable product or service agreement.

Indemnification

You agree to indemnify and hold harmless TruWatch and TruWatch International LLC, and their officers, employees, and agents, from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your provision of a mobile phone number that you are not authorized to use.

Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought in the state or federal courts located in Wisconsin, and you consent to the jurisdiction of those courts. This section does not override any dispute-resolution provisions in a separate product or service agreement between you and TruWatch.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the “Last updated” date above. Your continued use of the Site or participation in the SMS Program after changes take effect means you accept the updated Terms.
